Jharkhand HC quashes entire criminal proceedings against Birsa Blood Bank

Ranchi, June 29: The Jharkhand High Court on Wednesday quashed entire criminal proceedings against a city based blood bank, Birsa Blood Bank.

The order came from the court of Justice Sanjay Kumar Dwivedi after hearing a criminal writ petition filed by the blood bank facing charges of adopting irregularities in collection and transfusion of blood.

Advocate Abhishek Krishna Gupta, who had filed the petition on behalf of blood bank pleading innocence, informed this to lagatar24.com saying the order came after the criminal proceedings was on an advanced stage in the lower court and it has come as big relief for the blood bank management.

The case arose after drug inspector Poonam Tirkey registered an FIR at Bariatu police station against the blood bank alleging that the bank hurriedly collected the blood from donor and transfused blood to a patient on the same day suggesting illegal business of selling and purchase of blood. The FIR was registered on March 17, 2018.

As the FIR was registered on the behest of the then SDO (Sadar) Anjali Yadav, the matter hogged limelight and the blood bank management had to cut a sorry figure in the society.

Advocate Gupta filed a petition in 2020 when the trial in the matter was at an advanced stage. Gupta submitted before the court that whatever was done on March 17, 2018 was done in the interest of a patient, Baleshwar Prasad, who urgently needed blood and procuring blood was difficult.

He said there was no sale or purchase of blood as Asad Arif donated the blood. He said whatever was done by the blood bank was done in accordance with the Clinical Establishment Act.
