Delhi HC refuses to stay CCI probe into WhatsApp privacy policy

New Delhi, Aug 25: Whatsapp and Facebook’s petitions appealing a Competition Commission of India (CCI) ruling requesting a probe into the messaging services’ new privacy policy were dismissed by the Delhi High Court’s Division Bench.

While dismissing both petitions filed by WhatsApp and Facebook, the court’s bench of Justice Satish Chandra Sharma and Justice Subramonium Prasad on Thursday declined to further extend the stay granted on notices issued to messaging apps by the CCI.

The appeals were declared to be without merit by the bench. Following the conclusion of all parties’ submissions on July 25, 2022, the bench had reserved the order.

Senior Advocate Mukul Rohtagi, speaking on behalf of Facebook Inc., argued that just because Facebook is Whatsapp’s official owner and the platform is said to exchange data with Facebook (the parent firm), doesn’t always make it a necessary party for an investigation. While opposing the CCI investigation against Facebook, Rohtagi further stated that there is no prima facie evidence at the CCI’s disposal to move through with the investigation while also looking into WhatsApp’s new privacy policy.

Facebook and Whatsapp’s petitions against the single bench, which had dismissed their petitions, were being heard by the Division bench.
