Jharkhand CM nod to regularise unauthorised buildings constructed before Dec 31, 2019

Urban development department invites feedback on the draft proposal

Ranchi, Nov 19: The state Urban Development and Housing Department has issued a draft of “Plan 2022 to regularize unauthorized residential construction” to regularise buildings constructed without approval in urban areas before 31 December 2019.

 

“After the order of the Chief Minister, Plan 2022 has been prepared to regularize the unauthorized construction. The CM has given his consent as the departmental minister. Buildings constructed before 31 December 2019 will be regularised,” said an official note from the Chief Minister’s office.

 

The department has invited suggestions and feedback from the people in the next one month to make this scheme more effective and simple.

 

The Jharkhand Act, 2011 was notified for regularization of unauthorized construction done in urban areas through regularization fee, but a large number of people could not take advantage of this opportunity.

 

Again, the “Scheme to Regularize Unauthorized Constructions, 2019” was notified by the state government, but according to the information received from various bodies, authorities and organizations, this scheme also could not be effective in providing relief to the general public due to various reasons.

 

In the light of the above points, the need was felt that action should be taken once again to regularize the unauthorized construction by keeping it within the ambit of structural stability and planning criteria, the statement said.

 

Using the power given under Section 590 (1) and co-read Section-434 of the Jharkhand Municipal Act 2011, the state government has proposed a plan to regularize unauthorized construction. Under the scheme, residential and non-residential buildings constructed before December 31, 2019 will be regularized.

 

The height of the building can be up to 15 meters but the structure should be of ground + 3 storeys (G+3) only. And, plot area up to 500 sq.mt. (up to 100% of plinth area) and plot area above 500 sq.mt. whose plinth area should be 75% or 500 sq.mt. whichever is less.

 

Separate charges have been fixed for residential and non-residential buildings in different urban areas. In Nagar Panchayat areas, Rs 50 per square meter for regularisation of residential buildings and Rs 75 per square meter for non-residential constructions.

 

In the Municipal Council (Nagar Palika Parishad), the charge is Rs 75 per square meter for residential buildings and Rs 100 per square meter for non-residential buildings. In the Municipal Corporation/ Development Authority/ IADA/ NAC/ Municipality area, the amount for regularisation is Rs 100 per square meter for residential buildings and Rs 150 per square meter for non-residential constructions.
