Jamia violence 2019: Delhi HC issues notice on plea against discharge of Sharjeel Imam, others

New Delhi, Feb 13: The Delhi High Court has issued a notice on the appeal moved by Delhi Police against the discharge of Sharjeel Imam, Asif Iqbal Tanha, Safoora Zargar and eight others in connection with the violence that occurred at Jamia Millia Islamia in December 2019.

Justice Swarana Kanta Sharma issued a notice to Sharjeel Imam and others and clarified that the observations of the lower court will not affect the further investigation into the matter or trial.

“Since further investigation will be carried out, observations made against the investigating agency will not affect either further investigation or trial of any accused,” said the court after a detailed preliminary hearing.

The high court summoned the trial court record (TCR) in digitised form. While the HC has not summoned the case diary, it was submitted by one of the counsels that the TCR and case diary may be summoned.

On February 4, the trial court made some serious remarks while discharging Sharjeel Imam, Asif Iqbal Tanha, Safoora Zargar, Mohd. Abuzar, Umair Ahmed, Mohd. Shoaib, Mahmood Anwar, Mohd. Qasim, Mohd. Bilal Nadeem, Shahzar Raza Khan and Chanda Yadav in the case.

However, the Trial Court did not discharge Mohd. Ilyas as it remarked that there was sufficient evidence to frame charges against him.

Meanwhile, the ASG said that the observations were misconceived and will prejudice further investigation. The matter was listed for further hearing on March 16.
