Shiv Sena rift: SC to hear tomorrow Uddhav Thackeray’s petition against ECI decision

New Delhi, Feb 21: The Supreme Court on Tuesday decided to hear Uddhav Thackeray’s appeal challenging the Election Commission of India’s decision to recognise the Eknath Shinde group as the official Shiv Sena on Wednesday.

Uddhav Thackeray’s senior attorney, Kapil Sibal, brought the case before the Chief Justice of India for an urgent hearing. Sibal argued that urgent protection orders are required since the Shinde group is seizing control of the party’s offices and accounts in accordance with the ECI order.

After the Constitution Bench hearing tomorrow at 3.30 PM, CJI DY Chandrachud agreed to hear the case. Notably, the other matters connected to the Shiv Sena rift are being heard by the Constitution Bench, which is led by Chief Justice DY Chandrachud.

Sibal asked for the case to be heard today, but CJI Chandrachud refused, stating he wanted to study the files first.

In an effort to overturn the Election Commission of India’s decision to recognise the Eknath Shinde group as the official Shiv Sena, Uddhav Thackeray has filed a petition with the Supreme Court. Prominent attorney Dr. Abhishek Manu Singhvi brought up the issue before the Chief Justice of India and asked that it be included on the list of matters already before the Constitution Bench.

The ECI approved Eknath Shinde’s request on February 17 to assign the Shiv Sena’s official name and symbol, the ‘bow and arrow.’

The Supreme Court’s Constitution Bench is now deliberating over the matters pertaining to the Shiv Sena split. The Bench resolved to hear the case on the merits on February 17, 2023.
