San Francisco: A coalition of unions, employers, and religious groups has filed a lawsuit in a federal court challenging US President Donald Trump’s new H-1B visa policy, which imposes a one-time $100,000 fee on visa applications. The lawsuit argues that the fee is illegal, exceeds presidential authority, and threatens to disrupt innovation, research, and employment for thousands of skilled professionals.

Indian Postdoc Becomes Face Of The Legal Challenge

The lawsuit cites the example of “Plaintiff Phoenix Doe,” an Indian postdoctoral researcher based in Northern California, to illustrate the impact of the policy. Doe’s cap-exempt H-1B petition has been indefinitely paused because her university cannot immediately pay the exorbitant fee. She works on cutting-edge research into genetic and epigenetic causes of vision loss, including conditions related to aging, diabetes, and rare inherited disorders.

Her university considers her its first postdoctoral scholar leading this research and expected to continue her work for at least two more years. Due to the policy, however, her application process has been halted, putting her career and the university’s research at risk.

The lawsuit states that Doe is facing severe stress and anxiety due to the uncertainty, which worsens her PTSD. Without legal relief, she will be forced to leave her position and the US within four months — a move that could severely damage both her career and the lab’s ongoing research.

Lawsuit Warns Of Innovation Setback

The suit emphasizes that Doe’s departure would derail vital research, delay potential medical breakthroughs, and jeopardize the lab’s ability to secure future funding. Plaintiffs argue that the $100,000 fee is unprecedented — far exceeding the usual $2,000–$5,000 — and will “stifle innovation” by making it financially unfeasible for universities, nonprofits, and smaller companies to hire foreign talent.

The case is led by groups including the United Auto Workers union, the American Association of University Professors, the Justice Action Center, the Democracy Forward Foundation, the Global Nurse Force, and religious organizations. It also accuses federal agencies of bypassing proper rulemaking processes and ignoring the policy’s impact on the economy and research ecosystem.
