Gyanvapi mosque row: Court adjourns plea seeking rejection of Hindu suit till May 30

Varanasi, May 26: The hearing in the maintainability petition of the Anjuman Intezamia Masjid Committee, which oversees the Gyanvapi Masjid in Varanasi, was extended by the Varanasi district court on Thursday till May 30.

The committee was requesting that the Hindu petitioners’ appeal for unrestricted right to worship at the Shringar Gauri sthal inside the Kashi Vishwanath-Gyanvapi complex be dismissed due to accusations that a Shivling had been discovered on the property. Only petitioners, lawyers, and defendants were allowed inside the courtroom during the hearing. The hearing, which began at 2:00 p.m., lasted around two hours.

The Masjid committee contended that the Hindu side’s lawsuit was unmaintainable and should be dismissed under the Code of Civil Procedure’s Order (CPC) 7 Rule 11. It claimed that rumours concerning the ‘Shivling’ were being published to arouse people’s emotions.

One of the Muslim side’s advocates, Abhay Nath Yadav, gave various arguments in favour of dismissing the case. The videotape report of the court-appointed survey panel was received by all sides.

Notably, the district court was hearing the case after the Supreme Court stated that the case should be heard by a more mature and experienced judge. The Supreme Court ordered that a priority judgement be made regarding the Muslim committee’s plea challenging the suit’s maintainability.
