Mumbai, March 29: The Bombay High Court on Wednesday dismissed Mamata Banerjee’s application, to quash the complaint for allegedly insulting the national anthem during her visit to Mumbai last year for procedural lapses.
The order was passed by Justice Amit Borkar. In her appeal, Banerjee also asked for the quashing of the summons that had been issued to her by a Mumbai metropolitan magistrate at Sewree following the filing of a case against her by BJP Mumbai Secretary Vivekanand Gupta.
She also challenged a decision made by Special Sessions Judge RN Rokade, who urged the magistrate to reexamine the case and overturned the summons the judge had issued on procedural grounds.

The complaint against Banerjee said that she began singing the National Anthem while seated at a public event at the Yashwantrao Chavan Auditorium in Cuffe Parade, Mumbai, and thereafter rose up and sung two verses of the Anthem before suddenly stopping and departing the location.
According to him, Banerjee’s actions constituted an offence punishable by law under the Prevention of Insults to National Honour Act of 1971 since she disrespected and insulted the National Anthem.
After receiving a complaint from Gupta, the magistrate issued a summons for Banerjee to appear on March 2, 2022. Banerjee challenged it in front of the sessions court, which dismissed the summons and returned the case to the magistrate for further review. The CM filed a lawsuit before the High Court challenging the same.
She argued that the Sessions Court should have overturned the decision rather than sending it back to the Magistrate for reconsideration.
