Ranchi, Dec.3: Barhait MLA representative Pankaj Mishra today leveled allegation of concealment of fact by ED Deputy Director Debvrata Jha saying that the latter had filed a case of money laundering on the basis of an FIR registered at the Barharwa police station in which the police had given him a clean chit.
The allegation has been leveled filing a petition before the PMLA court in the Jharkhand capital.
Mishra, who is in judicial custody for laundering of money earned by illegal mining, alleged that the ED has filed the prosecution complaint (PC) (equivalent to a chargesheet) by suppressing the facts. He has added that the police other than him had also found minister Alamgir Alam innocent in the case which is the basis of the prosecution complaint (PC).
A source close to ED said Mishra’s application has no basis as the PC has been filed against him not only on the basis of the Barharwa police station case but also several others. According to the source, ED in its charge sheet has already mentioned about the influence of Mishra in Jharkhand saying the man threatens SP and IG from jail.
Another source said that the ED is relying on the Supreme Court order in the Madan Lal case in which the apex court had observed that scheduled offence is a separate offence which can be investigated. The sources quoted ED officials saying they are ‘least bothered what Mishra is saying before the court’ as they have sufficient evidence against him.
The source also quoted an ED official saying ‘other than Barharwa case four other FIRs are also made basis of the PC. Apart from this, as many as 52 cases of illegal mining are also with the ED.’
