New Delhi: The Supreme Court has granted six days of custody parole to Tahir Hussain, AIMIM’s candidate for Mustafabad in the upcoming Delhi elections. A former AAP councillor and accused in the 2020 Delhi riots case, Hussain can campaign daily from sunrise to sunset between January 29 and February 3, with strict restrictions in place.
Tahir Hussain, currently lodged in Tihar Jail, will be released at 6 AM and returned by 6 PM each day. The court has mandated him to pay ₹2 lakh per day in advance for security arrangements during his parole.
Court-Imposed Restrictions
Hussain is prohibited from visiting his home in Karawal Nagar or making any statements related to the case. However, he is allowed to visit the AIMIM party office for election-related activities. The bench, comprising Justice Vikram Nath, Justice Sanjay Karol, and Justice Sandeep Mehta, clarified that the decision cannot serve as a precedent for future cases.
Opposition To Parole
Additional Solicitor General SV Raju opposed the parole, arguing it could set a problematic precedent where prisoners might contest elections solely to secure temporary release from jail.
The parole application initially led to a split verdict by a two-judge bench, prompting the case to be heard by a three-judge bench.
Election Contest In Mustafabad
Hussain is contesting from Mustafabad, a constituency in Northeast Delhi, against AAP’s Adeel Ahmed Khan, BJP’s Mohan Singh Bisht, and Congress’s Ali Mahndi. The seat was previously held by AAP’s Haji Yunus.
Background On Tahir Hussain
Tahir Hussain was expelled from the Aam Aadmi Party (AAP) following his alleged involvement in the 2020 Delhi riots. He faces charges, including the murder of Intelligence Bureau official Ankit Sharma, rioting, and conspiracy. Hussain joined AIMIM last year.
