Mumbai, Jan 25: Kangana Ranaut has appealed the Chief Metropolitan Magistrate’s (CMM) Court’s order to transfer all proceedings in a lawsuit brought by lyricist Javed Akhtar against her to the Mumbai City and Civil Court, Dindoshi.
The actress claims that despite bringing the magistrate’s partiality to the attention of the CMM court, her plea was denied.
The petition was filed under section 408 of the Code of Criminal Procedure (CrPC) by the actress (Power of Sessions Judge to transfer cases and appeals).
She stated in her petition, which was filed through advocate Rizwan Siddiquee, that she was aggrieved by the orders of the Metropolitan Magistrate 10th Court, Andheri, which sufficiently proves the said magistrate’s acts of biased and prejudiced mind, and that she filed a plea under section 410 of CrPC before the CMM court (withdrawal of cases by judicial magistrates). Despite being informed of the magistrate’s partiality, the court issued a decision on October 21st dismissing the actress’ application for a transfer of the case submitted by Akhtar, according to the plea.
On December 31, 2021, the Sessions Court likewise denied her appeal on technical grounds. As a result, she has filed a new petition under section 408 of the CrPC, requesting that the proceedings be transferred to another court.
Shridhar Bhosale, an additional session judge, will hear the case on January 27. The judge has ordered Akhtar, who was represented by Jay Bharadwaj, to respond to her plea by the next date set.
In November of 2020, Akhtar filed a defamation suit against Ranaut for allegedly making defamatory and false remarks against him in a televised interview.
The actress accused Akhtar of extortion and criminal intimidation in a counter-complaint. She claimed that during her feud with her co-star Hrithik Roshan, Akhtar contacted her and threatened her, then demanded that she write a letter of apology to her co-star.
