Rahul Gandhi Tweet controversy: Delhi HC issues notice to Twitter

New Delhi, Oct 5: The Delhi High Court on Tuesday issued notice to Twitter on a plea seeking directions to Twitter and the Delhi Police to take action against Congress leader Rahul Gandhi for allegedly revealing the identity of a rape and murder victim in Delhi in his tweet.

The Bench of Justice DN Patel and Justice Jyoti Singh while issuing the notice to Twitteer only made “explicitly clear” that no notice is being issued to other respondents.

Senior Advocate Sajan Poovayya, informed the court from the Twitter side that the Rahul Gandhi’s tweet violated the policy and so that tweet was removed and his account was also blocked.

This submission came during a hearing of PIL seeking directions to the National Commission for Protection of Child Rights (NCPCR) and Delhi Police to take appropriate legal actions against Rahul Gandhi for his tweet allegedly disclosing identification of Delhi Cantt Rape Victim family. The petitioner Makarand Suresh Mhadlekar clamied to be a social activist has approached Delhi High Court to seek its intervention for appropriate legal action against Rahul Gandhi. The petition also seeks direction to Delhi Police to register an FIR against him under section of the Juvenile Justice (Care and Protection of Children) Act, 2015.

Advocate Gautam Jha who appeared for the petitioner said that Rahul Gandhi has violated Section 23(2) of the POCSO Act, 2012 and Section 74 of Juvenile Justice Act, 2015.

Notably, a nine year old girl was allegedly raped and killed by a priest and three employees of a crematorium near Delhi Cantonment in Southwest Delhi on August 1.
