SC allows amendment of BCCI constitution

New Delhi, Sept 14: Supreme Court on Wednesday approved the BCCI’s request to amend the BCCI Constitution to relax the requirement for a cooling off period.

Now, the 3-year cooling-off period will only be applicable if a person holds two consecutive terms at the State Association or the BCCI. The requirement for a cooling off time will also be applicable at that specific level, whether it be the State association or BCCI. In other words, even after serving two consecutive terms at the State level, the cooling-off time requirement will not prevent someone from running for election to the BCCI.

Board of Cricket Control of India (BCCI) filed a petition asking for permission to amend its constitution to remove the cooling-off period for holding two consecutive terms in a combination of BCCI and State Association. A division bench made up of Justices D.Y. Chandrachud and Hima Kohli issued the order.

It is important to note that this alteration would allow the BCCI’s current president, Saurav Ganguly, and secretary, Jay Shah, to run for reelection in the fall of 2022. Since they have served one term in both of the State Association and the BCCI, they would have been disqualified under the original provisions.
