New Delhi: The Supreme Court on Friday ordered that no action be taken regarding a private well located near the entrance of Sambhal’s Shahi Jama Masjid without prior permission. A bench led by Chief Justice of India (CJI) Sanjiv Khanna and Justice Sanjay Kumar directed authorities to maintain the status quo and submit a status report within two weeks.
The directive came after the Committee of Management of Shahi Jama Masjid challenged a November 19, 2024 order by the Sambhal Senior Division Civil Judge, which permitted the appointment of an advocate commissioner to survey the mosque premises.
Concerns Over Violence and Historical Significance
Senior advocate Huzefa Ahmadi, representing the mosque management, argued that the survey had sparked violence and loss of life, necessitating the Supreme Court’s intervention. Ahmadi highlighted the historical significance of the well, stating, “We have been drawing water from the well since time immemorial.”
Concerns were also raised over notices identifying the site as “Hari Mandir”, suggesting potential plans for religious activities. Responding to this, CJI Khanna remarked, “No such activities will be permitted. Please file a status report.”
Dispute Over the Well’s Location
The well’s location has been a contentious issue, with advocate Vishnu Shankar Jain, representing the Hindu side, asserting that it lies outside the mosque’s purview and has historically been used for worship.
Ahmadi countered, claiming that the well is partially within the mosque premises, referencing a Google Maps image to substantiate his argument. The mosque management requested the Sambhal district magistrate to ensure that no actions are taken regarding the well without court approval.
Challenging the Survey Order
The mosque committee’s plea contested the November 19 order, citing the lack of an opportunity to be heard. It also highlighted that a subsequent survey led to violence and fatalities, prompting the Supreme Court to intervene urgently.
