Delhi HC directs Centre to file comprehensive affidavit on Subramanian Swamy’s plea

New Delhi, Oct 31: The Delhi High Court ordered the Central Government on Monday to produce a fuller and more thorough document in order to reassure the court that Subramanian Swamy’s security concerns at his private residence would be appropriately addressed.

In response to a petition filed by former BJP MP Subramanian Swamy, the Delhi High Court gave the directive.

The Center was given additional time and instructed to prepare an affidavit by Justice Yashwant Varma. A follow-up hearing on the subject has been scheduled for November 3, 2022.

A copy of the affidavit was entered into the record by the Central Government’s attorney, who also notified the court that a joint security evaluation had been completed. The complete security system is prepared.

The attorney for Subramanian Swamy objected to the proposal and emphasised that no infrastructure-related action had been taken. According to the centre’s attorney, a permanent guard should have access to a space where they can rest and do other things before being deputised.

The Centre claimed that because workers were managing security throughout the city during the holiday season, no arrangements could be made. The High Court dismissed this claim.

“Oh please! Don’t float such general statements, that too, early in the morning. Did you withdraw security cover from him and place them to manage security during festivals?” the Court asked.

To refute the assertion made by the centre’s attorney, the petitioner’s attorney entered into the record a few images. The Center’s legal counsel requested if there is room, a guard room. If not, we can station 6 guards there and rotate them.

In addition, he suggested that we could put up a tent for the guards if there was no room. He will be granted his legal entitlements.

The bench asked the centre, ” When you will do it?”

“Just after he moved there.” the counsel for Central Government replied. The court took an objection to this and said, ” No, can’t you do it simultaneously?”

“Fix a guard room there. What is the difficulty in creating a guard room there,” the court questioned.

According to the centre’s legal representative, it is not feasible for every resident of a private colony.

On October 27, Swamy filed a petition with the High Court, stating that, contrary to what it had promised the court, the Central Government had not provided enough security at his private property.

The high court had ordered Swamy to leave the government housing in September.

The petitioner is a security protectee under the Z category, according to the counsel. The Central Government assured the court that security provisions would be made at the applicant’s private residence, but nothing has been done to that point.

On September 14, 2022, the Delhi High Court told BJP leader and former Rajya Sabha member Subramanian Swamy six weeks to leave the official residence. He received the housing assignment in January 2016.
