Ranchi: The issue of formation of TAC echoed loudly in Parliament. BJP state president and MP Deepak Prakash raised questions on the formation of TAC in the Rajya Sabha, terming the formation as unconstitutional. Also said that the Hemant government of Congress and JMM has constituted Tribal Advisory Council in violation of the Constitution and disregarding the inherent powers of the Governor. Asking the question in the house, he said that for the all-round development of the tribal society, he has given the right to constitute TAC i.e. Tribal Advisory Council under the 5th Schedule of the Constitution. In which the power of the governor is also vested, but the Hemant government has formed TAC, abolishing the powers of the governor. He said that the minister should tell what action has been taken by the central government on this.
Protection of rights of tribes should be ensured – Munda
Responding to Deepak Prakash’s question, Union Tribal Welfare Minister Arjun Munda said that this topic is sensitive. Tribal areas are given special rights under the 5th schedule. The constitutional rights which are there should be used properly. He said that the formation of TAC in Jharkhand is under the notice of the ministry. The protection of the tribes, the rights of the governor and the rights given under the constitution should be ensured. States should pay special attention so that TAC is not used for personal gain.
TAC was formed on June 22 under the new rules
It is noteworthy that the Ministry of Home Affairs has sought a report from the state government on the formation of TAC. The state government had notified the Jharkhand Tribes Advisory Council Rules-2021 on June 4, amending the rules for the formation of TAC Under the new rules, the right to select the members of TAC has been given to the Chief Minister, whereas earlier the approval of the Governor was necessary. On June 22, TAC was formed on the basis of new rules. The state’s opposition party BJP had lodged its objection to the new rule and called it unconstitutional
