Ranchi, Aug.13: A single bench of Jharkhand High Court comprising Justice Sanjay Kumar Dwivedi, hearing a petition demanding a CBI probe into the death of Sub Inspector Rupa Tirkey, referred the case to the Chief Justice after Advocate General (AG) Rajeev Ranjan showed his reluctance to file his submission before the court in the form of an affidavit.
The court asked AG Rajan to file his submission in the form of an affidavit when the latter at the beginning of the hearing submitted that the petitioner’s advocate Rajeev Kumar was heard saying that 200 percent the matter is going to be allowed. Submitting this, he urged the court to remove the matter from the list of this court.
“When AG Ranjan showed his reluctance to file his submission in the form of an affidavit saying whatever he had submitted before the court was sufficient, the court directed the registry to place the matter before the chief justice on the administrative side,” a high court lawyer said.
“The court only with a view to faith that the common man reposes in the judiciary sent the matter before the Chief Justice on the administrative side to take a decision,” the lawyer added.
Petitioner’s lawyer Rajeev Kumar confirmed the development saying the ‘advocate general mentioned my talk with my client on last date on August 11 after the argument from both the sides completed and the matter was adjourned for two days for further argument by the rest of the counsels.’
Asked how come the AG heard it, Kumar said: “I forgot to turn off my camera after the hearing was completed and started talking to my client.” Asked why he said 200 percent the matter is going to be allowed, he said: “My intention was only to make my client hopeful like any practicing lawyer. Not more than that.”
Hearing in the petition had started on June 17 this year.
The petition arose after Rupa was found hanging at Sahibganj on May 3 and the matter hogged limelight with a suspicion that she was provoked to commit suicide by someone close to the chief minister.
Police arrested batch mate of Rupa in this connection saying he provoked her for suicide but very few bought the logic of police.
Common perception remained that someone close to the chief minister was involved in the case and the government is trying to save him.
