Legislature must evaluate and amend laws to meet interests of people: CJI

Cuttack, Sept.25: Justice N V Ramana, India’s Chief Justice, stated on Saturday that the legislature needs to evaluate and revise laws to meet the demands of time and people so that they are in line with “practical realities.”

While laying the foundation stone for the new Odisha State Legal Services Authority building here, the CJI also stated that the administration and legislature must work together to realise “constitutional aspirations.”

“I emphasize, our laws must match with our practical realities. The executive has to match these efforts by way of simplifying the corresponding rules,” Justice Ramana said. According to him, it is important for the Executive and Legislature to “function in unison in realising Constitutional aspirations.” The CJI remarked that only then would the judiciary be free to implement and interpret laws rather than be forced to act as legislators.

He emphasised that, at the end of the day, it is the harmonious operation of the three state organs that may remove procedural hurdles to justice. The CJI also stated that the Indian judicial system faces two difficulties, the first of which is the Indianization of the justice delivery system.

Traditional and rural societies, which have been following customary ways of life for 74 years, “are afraid to approach the courts. The practises, procedures, and language of our Courts feel alien to them,” he added.

He did, however, say that, despite the harsh reality, the Indian judicial system frequently fails to reflect social realities and repercussions. “Unfortunately, our legal system is set up in such a way that much is lost by the time all the facts and law are churned up in the courtroom. People may bring their troubles to the courts, but at the end of the day, it’s just another case”, according to the CJI.
