New Delhi, Feb23: The Supreme Court suggested on Wednesday that the name of Sanjay Leela Bhansali’s film Gangubai Kathiawadi be changed in light of various court cases trying to prevent the film’s release on Friday, February 25.
An appeal was filed against a Bombay High Court order that continued the stay on summons issued by a Mumbai court in a criminal defamation complaint against the producers of Gangubai Kathiawadi, actress Alia Bhatt, and authors S Hussain Zaidi and Jane Borges, who wrote the book on which the film is based, by Justices Indira Banerjee and JK Maheshwari.
Gangubai’s adopted son filed a lawsuit seeking an injunction prohibiting Bhansali Productions from creating, directing, or releasing the trailer for any film based on the novel, including Alia Bhatt’s Gangubai Kathiawadi.
The petitioner claims that in a defamation case, the balance of convenience must always be in favour of the defamed individual.
Furthermore, it is argued that the Bombay City Civil Court was not justified in dismissing the complaint under Order VII Rule 11(d) CPC based solely on two Madras High Court judgements, which should only be considered persuasive by the Court.
The case’s hearing will continue tomorrow.
