BJP MP Nishikant Dubey to move Delhi HC against order to stay Lokpal move

New Delhi, Sept 13: BJP MP Nishikant Dubey is set to move the Delhi High Court against its decision to stay the hearing of the disproportionate assets case against JMM chief Shibu Soren by the Lokpal.

 

Dubey had filed a petition before the Lokpal against JMM chief and Rajya Sabha MP Shibu Soren for amassing disproportionate assets in his name as well as family members and others. He demanded a CBI probe into the matter. But the BJP suffered a setback on Monday when the court of Justice Yashvant Varma stayed the proceedings of the Lokpal. The court passed the order while hearing a criminal writ petition filed by Shibu Soren.

 

Well placed sources said that Dubey is going to approach the court with the contention that the court passed the order without hearing him. Sources close to him said that Nishikant Dubey was not aware that Shibu Soren had challenged the Lokpal’s order before the Delhi High Court and the matter was listed for scheduled. This was because of the reason that Shibu Soren as a petitioner did not give him any advance notice; hence, he could not represent himself before the court.

 

In this case before the Delhi High Court, the Lokpal and Nishikant Dubey are the first and the second respondent, respectively. Both remained unrepresented and the court mentioned this fact also.

 

“Although the first and second respondents are stated to have been placed on advance notice, none has appeared on their behalf when the matter was called. Consequently, let learned counsel for the petitioner take steps for service upon the second respondent through all permissible modes including via approved courier service,” the court order reads.

 

Consequent upon the petition of Nishikant Dubey, the Lokpal had ordered the CBI to conduct a preliminary enquiry into the matter. The petitioner submitted a list of 57 immovable properties of Shibu Soren and his family members. The CBI submitted a detailed enquiry report where it is stated to have given a list of 82 such properties.
