Mumbai, Sept 23: The Bombay High Court ordered on Friday the Mumbai Municipal Corporation to allow the Shiv Sena faction led by Uddhav Thackeray to hold its annual Dussehra rally in Shivaji Park in Dadar, Mumbai this year.
A decision by the Brihanmumbai Municipal Corporation (BMC) to deny permission for the rally to take place was overturned by a panel of Justices RD Dhanuka and Kamal Khata.
“Our view is that decision taken by BMC is not a bonafide decision,” the Court said.
The Shiv Sena has been given permission by the court to stage the demonstration in Shivaji Park from October 2 to October 6, 2022.
The Court made it clear that police might freely videotape the entire event and that any questionable behaviour could be a reason to deny authorization the next year.
Video recording of the entire function to be done and if it's found that petitioners are responsible for creating any law and order situation, it would affect their permission in future, the Bombay High Court observes.

The Bench noted that BMC was unable to explain why the application was not taken into consideration between August 22 and September 21, 2022. Through the Eknath Shinde group submitted an intervention application in opposition to the case.
Aspi Chinoy, an attorney for the Thackeray faction, said that the Shiv Sena has been holding its annual Dussehra Melawa (Rally) at Shivaji Park since 1966 when the case was up for court on Friday.
He stated that, in accordance with the government resolution, Shiv Sena is entitled to hold the Dussehra melawa (rally). The Court after hearing all parties rejected the intervention application by Sarvankar and allowed the Thackeray faction’s petition.
