Mumbai, Nov 9: Sanjay Raut, Rajya Sabha MP from the Shiv Sena’s Uddhav Thackeray faction, was granted bail by a special court on Wednesday. The Enforcement Directorate (ED) filed a petition with the Bombay High Court to challenge this decision. Justice Bharati Dangre heard the case and decided to list it for tomorrow but declined to suspend the bail order.
She argued that since the agency’s filed plea was made according to Section 439(2) of the Code of Criminal Procedure (CrPC), she could not provide broad directions as asked by ED.
“I will hear it tomorrow on the aspect of 439(2). If you (ED) want Section 482 stay that is a different part, you have not come to me under Section 482. That jurisdiction is different,” Justice Dangre said.
She pointed out that while the High Court has power to suspend order of bail under Section 482 CrPC read with Section 439, the plea by ED was limited to the prayer under Section 439.
This would imply that Raut will be released from custody today.
In accordance with the Prevention of Money Laundering Act, Raut was today granted bail by the Special Court in a money laundering case.
Even before the parties had access to the order, the agency moved the High Court to challenge it within hours. Notably, the ED detained Raut on July 31 in connection with the money laundering investigation.
