New Delhi, Jan 12: The Maharashtra government was ordered by the Bombay High Court on Thursday to respond to a petition filed in a sales tax case by Bollywood actress and producer Anushka Sharma.
The Maharashtra Value Added Tax (MVAT) Act orders issued by the Deputy Commissioner of Sales Tax at Mazgaon, Mumbai, raising dues for the assessment years 2012–2013 and 2013–2014 have been contested by the actress.
Sharma claimed in her petitions that the assessing officer (AO) had improperly imposed sales tax on the compensation she received for endorsing and hosting award ceremonies.
For the assessment year 2012-13, the sales tax levied was Rs1.2 crore (inclusive of interest) on the consideration of Rs12.3 crore, for the assessment year 2013-14, the tax levied was Rs1.6 crore on approximately Rs17 crore consideration, the actress said in her plea.
She claimed that AO had incorrectly determined that she had obtained copyright through endorsements and anchoring award functions, sold, or otherwise transferred it. The actress argued that the producer, who also held the videos and performer’s rights, always retained the copyright of videos, which could not be sold or transferred.
She had filed the petition in December through her tax consultant, however, a Bench led by Justice Nitin Jamdar had taken exception to the same.
