Ranchi, Sept 7: The final hearing in the matter of court fee will take place on September 26 before the Jharkhand High Court. After the state sought time of 15 days to file a reply in the matter, the division bench of chief justice Dr Ravi Ranjan and Justice S.N.Prasad took this decision.
Jharkhand State Bar Council president Rajendra Krishna, who is arguing in the PIL challenging the Court Fee Amendment Act of the state government, informed this to Lagatar24.com saying the situation came when the state suggested minor modification in the law and we expressed our dissatisfaction over it.
Before the date of final hearing was fixed, Jharkhand Bar Council president Krishna requested the court to issue an interim order allowing payment of old fee till the final order in the matter but the same was not allowed by the court as the state government opposed it.
It was told by the government that there have been positive talks with the officials of the government on some points and thus it will not be proper to pass any interim order in the matter.
Notably, the petition was filed challenging the wild increase in court fees. The petitioners have shared the concern of poor sections of the society who are likely to be deprived of judicial remedy due to increase in court fee.
The petition suggests that it will not be possible to provide easy and accessible justice to the people due to the increase in court fees. It suggests that the court fee act of the state government is wrong and against the Central Court Fee Act.
