Ranchi, Aug.2: Jharkhand High Court today issued notice to Chief Minister Hemant Soren while hearing a bail petition filed by Rishikesh Kumar, accused of passing derogatory remarks against the chief minister.
The notice has been issued from the court of Justice Rajesh Kumar under Section 15 of ST/SC Prevention of Atrocity Act, a high court lawyer said.
Additional Advocate General (II) Sachin Kumar confirmed this explaining the rule under which the notice was issued.
“Notice has been issued to Soren in the capacity of a victim of atrocity, and not in the capacity of the chief minister under Section 15 of ST/SC Prevention of Atrocity Act. It is a fall out of an FIR registered on June 4 this year in Garhwa,” the AAG said confirming the issuance of notice.
Asked about Section 15 of the concerned act, the AAG said: “The provision restricts the court to pass any order before hearing the victim under ST/SC Atrocity Act and thus a notice has been issued to give the victim an opportunity to present his side.”
A police official in Garhwa said: “Rishikesh, son of the councillor of ward no. 4, Raj Kumar Prasad, had passed some lewd comments taking the caste of the chief minister. A JMM worker, Amar Ram, had taken strong exception to this and filed a case at Bansidhar Nagar police station on June 4 demanding action against Rishikesh.”
“An FIR was registered under sections 499, 500, 504, 124 A, 153 A of IPC and ST-SC Prevention of Atrocity Act and Rishikesh Kumar was arrested,” the police official said.
