Ranchi, Jan.31: There is no threat to legislatureship of BJP leader Samri Lal.
The Jharkhand High Court has allowed Lal’s petition challenging cancellation of the caste certificate which gives him scheduled caste (SC) status in Jharkhand and thus make him eligible for contesting assembly election from Kanke constituency, which is reserved for SCs.
The order came from the court of Justice Rajesh Shanker, where judgment in this case had been reserved on January 10 after hearing the arguments of petitioner Ramchandra Baitha and Lal.
The court termed the cancellation of Lal’s caste certificate by the State Scrutiny Committee as wrong and quashed the order of the State Scrutiny Committee to reject Samri Lal’s caste certificate. The court, however, observed that the government can get Lal’s caste certificate checked as per the rules by forming a committee again.
Additional advocate General Ashutosh Anand and Advocate Ashish Thakur appeared on behalf of the State Government and supported the cancellation saying that Lal is native of Rajasthan and a native of other states is not eligible for reservation status in Jharkhand.
On behalf of Lal it was submitted that he is a permanent resident of Jharkhand as his grandfather had come to Jharkhand in 1928.
