Jharkhand High Court Upholds Preventive Detention of Aman Singh, Dismisses Plea

Ranchi: The Jharkhand High Court has dismissed a petition challenging the preventive detention of Aman Singh alias Aman Shekhar under the Crime Control Act. The court ruled that the accusations made by the petitioner against jail authorities lacked evidence, and that the detention was legally justified.

Court Finds Detention Lawful and Justified

The division bench of Justice Sujit Narayan Prasad and Justice Arun Kumar Rai stated that Aman Singh’s activities fit the definition of “anti-social elements” and the district administration’s satisfaction behind issuing the detention order was both reasonable and lawful.

The preventive detention order, initially issued by the East Singhbhum District Magistrate on May 14, 2025 under Sections 12(1) and 12(2) of the Jharkhand Control of Crimes Act, 2002, was extended twice — on July 30 and October 30, 2025. These extensions were also confirmed by the Home Department on July 8, August 11, and November 7, 2025.

Eight Criminal Cases Against Singh

Aman Singh faces at least eight criminal charges, including attempt to murder, extortion, theft, and violations of the Arms Act. Police reports classified him as a habitual offender engaged in serious criminal activities.

Petitioner Claimed Rights Violation

Singh’s counsel had argued that the detention extensions were issued mechanically and violated Article 22(5) of the Constitution, as he was allegedly denied a fair opportunity to represent his case. They also claimed no new offense occurred to warrant repeated extensions.

State Defended the Action

The government countered that preventive detention was essential to maintain public order and prevent future crimes, citing a clear threat if Aman Singh were released.
