A letter petition has been moved before the Allahabad High Court seeking a probe by the Central Bureau of Investigation (CBI) or a Special Investigation Team (SIT) into the Lakhimpur Kheri incident in Uttar Pradesh eight people including four farmers died after they were mowed down by a four-wheeler driven by the son of Union Minister Ajay Mishra (Swadesh & Prayag Legal Aid Clinic and ors. v. State of UP)
The letter plea moved by NGO, Swadesh and Prayagraj Legal Aid Clininc said that the incident took place despite the fact that the State machinery through the police and its Intelligence units keeps an eye on the securities measures adapted before any VIP movement, reports Bar and Bench..
“Article 21 of the Constitution guarantees citizens right to life and personal liberty. State machinery has failed to secure lives of 8 persons who died in a dreadful manner,” the plea said.
It was further contended that the law and order situation in Uttar Pradesh is in great danger and there could be consequences if preventive action is not be taken by the State at earliest.
It was prayed that a suo motu public interest litigation petition should be registered based on the letter and cognizance should be taken against the respondent State authorities in the matter.
The plea also sought suspension of Director General of Police and other concerned officers and an independent judicial inquiry.
According to Times Now, a first information report has already been registered against Ashish Mishra (son of minister Ajay Mishra), and fifteen others for murder, unlawful assembly, rash driving and inciting violence.
