Ranchi, Dec.7: Taking a serious view of the Jharkhand High Court’s direction to stop construction of a boundary wall being carried out by a tribal lady on her land in the presence of police personnel, Mandar MLA and executive president of Congress party Bandhu Tirkey today told Lagatar24.com that he will raise such matters on the floor of the house in the forthcoming winter session of the assembly.
“This is not the only matter. There are several matters in my knowledge in which it has been observed that encroachers play victim citing one law after another and poor land owners losing their land fail to take judicial remedy due to consumption of time, money and energy,” Tirkey said.
The order came on Monday afternoon from the court of Justice Sanjay Dwivedi. The court was informed by advocate Ritu Kumar and Rohit Ranjan Sinha that a practicing lawyer Amrendra Pradhan and a medical officer along with his family members got confined in their house at Gauri Shanker Nagar under Argora police station after a lady Rita Binita Dhotre (Toppo) started constructing boundary wall at the entrance of their houses despite request of civic authorities in the presence of police.
The court took serious note of the information and directed to stop the construction immediately and asked the senior superintendent of police to turn up before the court by 10.30am today with a compliance report today.
The court while giving the direction took the matter as an issue of violation of Article 21 of the Constitution of India and that hurt the dignity of a practising advocate and a doctor.
Advocate Ritu Kumar confirmed the development saying following the court order, the tribal lady and the SSP appeared before the court seeking four days time for compliance with the order and the court granted it.
Contacted officer-in-charge of Argora police station, Vinod Kumar, for his comment, he said the role of police is limited in the matter and concerned circle officers and other allied officials have already intervened in the matter.
