Dhanbad Aug 24: Special MP MLA court of Dhanbad today upheld lower court’s decision of 18 months jail sentence and fine of Rs 9,000 on BJP Baghmara MLA Dhulu Mahto and four other in nine years old case of forcibly freeing a warranty from police custody.
The special court of Akhilesh Kumar (ADJ-16) today discharged the appeal of Dhulu Mahto and four other and upheld the punishment of lower court of 18 months jail term and Rs 9,000 fine. Special court had completed the hearing of the case on August 10, 2022 and fixed the date today August 24 for delivering the order.
Earlier the court of division judicial magistrate Sikha Agrawal had on October 9, 2019 held Dhulu Mahto and his four associates guilty for obstructing in government work and exonerating warranty Rajesh Gupta forcibly from the police custody. The court had given punishment of 18 months jail terms and fine of Rs 9,000 to named accused Dhulu Mahto, Rajesh Gupta, Chunchun Gupta, Ganga Prasad Gupta and Rameshwar Mahto. The court had absolved 6th accused Basant Sharma from the charge.
The case is nine years old. Dhulu Mahto and his associates on May 12, 2013 forcibly freed Rajesh Gupta, a warranty. As per charge sheet MLA Dhulu Mahto stopped Barora police in Nichitpur under Barora police station and took the accused from police van.
Advocate Radheyshyam Goswamy and Jitendra Singh, the lawyers of Dhulu Mahto after ruling said that MLA would challenge the order in High Court.
