Mumbai, Jan 25: In a case of obscenity filed against Shilpa Shetty after Hollywood actor Richard Gere publicly kissed her at a promotional event in Rajasthan in 2007, a Mumbai court on Monday freed the Bollywood actress.
Following a review of the allegation that sparked the case, Metropolitan Magistrate Ketaki Chavan concluded that Shetty appeared to be a victim of the crime committed by Gere, the main accused in the case.
“Not a single element of any of the alleged offence is being satisfied in the complaint. Moreover, none of the paper annexed with the final report discloses act of present accused so as to bring her within the purview of Section 34 of IPC (common intention).”
The Magistrate was convinced that the allegations against Shetty were without merit after reviewing the police report and documentation produced, and she was thus released from the charges.
Following the event, a complaint was made with a Judicial Magistrate First Class in Mundawar, Rajasthan, requesting the filing of a FIR against Shetty and Gere, which was granted.
The accused was charged with violating Indian Penal Code Sections 292, 293, and 294 (obscenity), as well as the laws of the Information Technology and Indecent Representation of Women (Prohibition) Act.
