Ranchi, June 2: The National Commission of Scheduled Tribes (NCST) has decided to investigate the case of abusive and defamatory language allegedly used by the DSP of Sahibganj police, Pramod Mishra, against the deceased ASI Rupa Tirkey whose murder case the CBI is investigating.
The Commission has sent a notice to the DGP of Jharkhand Niraj Sinha and Ranchi SSP Surendra Kumar Jha to submit all the documents related to this case as the Commission has decided to investigate/inquire into the matter in pursuance of the power conferred upon it under Article 338A of the Constitution of India.
The Commission has further directed them to submit documents within 30 days of receipt of the notice. In the case of the failure to comply with the notice, the Commission has said that it would exercise the powers of the Civil Court conferred on it under Article 338A of the Constitution of India and the concerned officers can be summoned for their appearance in person or by a representative before the Commission. The Commission issued notice on May 24 on the basis of a complaint lodged by Padmavati Oraoin who is the mother of the deceased cop. In January this year, she had lodged a complaint that despite the order of the judicial magistrate, the Ranchi police did not lodge an FIR against the accused person who outraged the modesty of her deceased daughter. However, after much uproar, the Ranchi police lodged an FIR against Pramod Mishra and Pankaj Mishra under provisions of the IPC and SC-ST Prevention of Atrocities Act.
Top sources in the Commission confirmed the notice was sent and Jharkhand Police has also submitted the relevant documents.
“The notice doesn’t turn out to be infructuous even if the police lodged an FIR. The Commission takes action and issues notice to ensure justice and to carry a case to its logical conclusion. The cause of justice doesn’t end with the police lodging an FIR. The Commission has called for documents to examine whether the probe was carried in the right direction. The matter will be placed before the member of the Commission Anant Nayak who will decide the next course of action,” said a senior official of the Commission.
Sometimes after the death of Rupa Tirkey, some of her private conversations with her friend Shiv Kumar Kanaujia became viral. The family alleged that the DSP leaked the audio clips to tarnish her image. The worst happened when another audio of a telephonic conversation of the DSP with a private person became viral. In the audio the DSP is heard casting aspersions on the character of Rupa Tirkey and making the sexiest remarks.
In both matters, the family contacted the local police for the FIR. But they returned empty-handed. Later on, they approached the court of Special Judge of SC ST of Ranchi which on December 2, 2021, directed the Ranchi police to lodge an FIR.
