No record to suggest Kanke MLA’s kin staying in Jharkhand since 1950, govt tells high court

Ranchi, Dec.20: The Jharkhand government has no document and record suggesting Kanke MLA Samri Lal’s family has been staying since or before 1950 in Jharkhand.

The Jharkhand government submitted the same through its lawyer in the Jharkhand High Court where legal proceedings to decide Lal’s caste certificate is going on.

The matter reached before the court after the state caste scrutiny committee cancelled Lal’s caste certificate and Lal, who had contested and won assembly election as BJP candidate from SC reserved Kanke assembly seat, challenged the cancellation.

Lal submitted before the high court that a caste certificate once issued to him after local enquiry can not be cancelled. He cited various Supreme Court orders in his favour. According to him, only the Caste Investigation Committee does have the right to cancel the caste certificate, not the caste scrutiny committee. According to him, caste certificates issued under verification and inquiry cannot be questioned.

Now further hearing in the matter will take place on January 9, 2023. On that day Suresh Baitha’s advocate will argue in favour of cancellation.

Baitha in his affidavit has argued in favour of caste cancellation saying Lal is a native of Rajasthan state and an outsider cannot enjoy the reservation facility.
