New Delhi, July 11: The Supreme Court put an pause to the legal conflict between Team Thackeray and Team Shinde for control of the Shiv Sena. The court declined to convene an urgent hearing on the MLA disqualification notifications filed by the opposing factions.
The Supreme Court said that Rahul Narwekar, the newly elected Speaker of the Maharashtra Assembly, should be told that he should postpone making decisions regarding the disqualification notices until the court makes a decision.
The matter, which comprises several petitions, will require the formation of a bench and take some time to be listed, according to Chief Justice of India NV Ramana.
This happened after the petitions, which were initially due to be considered in court today, were left off of the list that had been amended. Following that, the Thackeray-led camp demanded a quick hearing. Senior attorneys Kapil Sibal and Abhishek Manu Singhvi contended that despite four judicial orders, the petition was not filed on the docket for the top court on behalf of the Uddhav Thackeray camp.
A senior figure in the Uddhav Thackeray camp and Shiv Sena MP Sanjay Raut previously stated that the petitions are “a big test” for the “free and fair” court.
A number of petitions from the Uddhav Thackeray and Maharashtra Chairman Minister Eknath Shinde camps, who led the uprising against the Shiv Sena chief and overthrew his administration, are currently being heard by the Supreme Court.
One of the arguments made before the court relates to the 15 parliamentarians from the Shinde camp who have been issued pending disqualification notifications. Since the Assembly did not have a Speaker at the time, notices were issued by Deputy Speaker Narhari Zirwal.
Sunil Prabhu, the Uddhav Thackeray faction’s Chief Whip, has filed a second petition asking for the suspension of Shinde and 15 of his fellow MLAs from the assembly.
Additionally, Eknath Shinde’s appointment as Chief Minister has been contested by Team Thackeray. A different petition contests the choice of Governor Bhagat Singh Koshyari to ask Shinde to form the administration.
