New Delhi: The Supreme Court on Tuesday adjourned the hearing of bail petitions filed by former JNU students Sharjeel Imam and Umar Khalid, along with Gulfisha Fatima, Meeran Haider, and others, in a UAPA case linked to the alleged conspiracy behind the 2020 Delhi riots. The matter will now be taken up on September 22 by a bench comprising Justices Aravind Kumar and Manmohan.
Challenge To Delhi HC’s Order
The petitioners have challenged the September 2, 2025, order of the Delhi High Court that refused them bail, holding that conspiratorial violence cannot be permitted under the guise of protests. On the same day, another bench of the High Court dismissed the bail plea of co-accused Tasleem Ahmed.
High Court’s Observations
The High Court noted that while participation in peaceful protests and delivering speeches at public gatherings are protected under Article 19(1)(a) of the Constitution, such freedoms cannot be misused to incite violence or disrupt public order. The court had stressed that constitutional rights come with corresponding responsibilities.
