New Delhi, Dec.15: The Supreme Court, on Wednesday, awarded Mumbai businessman Raj Kundra four weeks’ immunity from arrest in one of numerous cases against him involving claims of shooting and broadcasting pornographic content.
The Maharashtra government was also served with a notice by the Supreme Court.
Kundra, the husband of Bollywood actress Shilpa Shetty, had petitioned the Supreme Court after the Bombay High Court denied his request for anticipatory relief on November 25.
In his plea to the High Court, Kundra said that the movies, while sensuous, did not reveal any physical or sexual conduct. He further stated that he was wrongfully implicated in the case and that he was not involved in the making or airing of such recordings.
In the same case, the High Court denied anticipatory bail applications from five other defendants in the original pornography case from last year. These included actors Poonam Pandey and Sherlyn Chopra.
Kundra was apprehended in July in connection with a separate case under investigation by the Mumbai Crime Branch.
He was detained for reportedly making and distributing pornographic films through the ‘Hotshots’ subscriber-driven smartphone app. In September, he was granted bail in that matter after a Rs.50,000 bond.
Kundra had filed that bail motion in the Metropolitan Magistrate Court, claiming that the prosecution had shown no proof linking ‘Hotshots’ to the authorities’ claims that it had been used for uploading and broadcasting obscene content.
