New Delhi, Aug 24: The Supreme Court said on Wednesday that a bench led by Justice DY Chandrachud would hear cases involving the Board of Control for Cricket in India (BCCI), including those involving altering its constitution.
A bench led by Chief Justice N V Ramana noted that a previous ruling in the BCCI cases was made on August 9, 2018, by a panel that included then-CJI Dipak Misra and Justices A M Khanwilkar and Chandrachud. Justices Misra and Khanwilkar have since retired, the bench, which is also made up of Justices Hima Kohli and C. T. Ravikumar, noted.
“Now, Justice Misra and Justice Khanwilkar are not there. I will list it before Justice Chandrachud and two more judges,” the CJI said.
The hearing on the BCCI’s request for the cricket organisation to change its constitution regarding office bearer tenure was postponed by the top court on July 21 after senior attorney Maninder Singh was nominated as an amicus curiae to help it in the BCCI concerns.
By eliminating the required cooling-off period between office-bearer tenures across state cricket organisations and the BCCI, the cricket body is attempting to modify its constitution with regard to the terms of its office bearers, including President Sourav Ganguly and Secretary Jay Shah.
Earlier, the top court adopted the BCCI reform recommendations made by the committee headed by Justice RM Lodha.
By eliminating the cooling-off period for its office holders, the BCCI hopes to allow Ganguly and Shah to remain in their positions even after serving six years each as president of their respective state cricket bodies.
