New Delhi, Aug 22: The Delhi High Court’s order to file a First Information Report (FIR) against BJP MP Syed Shahnawaz Hussain over a rape complaint was stayed by the Supreme Court on Monday.
While arguing that the case required consideration, a bench of Justices UU Lalit, S Ravindra Bhat, and Sudhanshu Dhulia also ordered a stay of all ongoing proceedings in the trial court.
“Stay of the further proceedings and also the effect and operation of the HC order under challenge”, the top court ordered.
The court provided the protection while considering an appeal of an order made by single-judge Justice Asha Menon of the Delhi High Court, who stated that the police had much to explain for failing to file a FIR against Hussain following receipt of a complaint that clearly revealed the commission of a rape after the administration of a stupefying substance.
The single judge made these views while listening to an appeal of a Special Judge’s decision upholding the MM’s orders requiring the registration of a FIR.
The charges made by the complainant were not supported by the investigation, the police had informed the MM. Despite this, the MM issued an order mandating the filing of a FIR in response to the Supreme Court’s ruling in Lalita Kumari v. Government of Uttar Pradesh.
This judgement was subsequently upheld by the special judge. The High Court then denied Hussain’s request for relief, which prompted an appeal to the Supreme Court.
