Shinde-Fadnavis govt lifts restrictions on CBI probes in Maharashtra

New Delhi, Oct 21: The limitations on CBI investigations in the state have been eased by the Maharashtra government, led by Chief Minister Eknath Shinde. Now every case can be investigated without restriction by the central investigation agency.

The CBI was subject to restrictions under the previous Maha Vikas Aghadi administration, which was led by then-Chief Minister Uddhav Thackeray. One of these restrictions required the CBI to obtain state consent before beginning an investigation.

Uddhav Thackeray signed the Home department’s petition on October 21, 2020, to deny the CBI permission to conduct an investigation in the state. The state’s home minister at the time was Anil Deshmukh. In both the money laundering case and the bomb scare case involving Antilia, Deshmukh is currently on trial.

The CBI must now request case-specific authorization from at least seven states that have revoked their general consent. The BJP-led Center has been charged by the opposition with regularly exploiting the CBI and ED for political purposes.

The Delhi Special Police Establishment Act, which establishes the CBI as a special division of the Delhi Police and limits its initial territorial authority to Delhi, governs the organisation.
