SC to hear plea arising out of Delhi HC verdict on marital rape

New Delhi, Sept 9: The Supreme Court announced today that it would hear the appeals arising from the Delhi High Court’s split decision on the subject of criminalising marital rape on September 16.

On May 11, the top court delivered a decision, with one judge favouring the repeal of the legal provision protecting husbands from prosecution for having extramarital affairs with their spouses while the other judge declined to declare it illegal.

However, given that the case includes important legal issues that the Supreme Court must decide, both judges had concurred in giving the certificate of permission to appeal to the high court.

Two petitions related to the high court’s decision from May 11 were heard on Friday before a bench made up of Justices Ajay Rastogi and BV Nagarathna.

The attorney representing one of the appellants stated that they are asking the supreme court to decide the important legal issue at hand.

The attorney claimed that the certificate of leave to appeal to the top court had been approved by both the judges on the high court’s division bench.

“Otherwise also, this matter has to be heard,” the bench observed, adding one more plea on the issue that was earlier mentioned before it.

“Let the other matter come, we will tag all of them,” the bench said.
