Bombay HC directs BMC to accept Rutuja Latke’ resignation for Maharashtra bypolls

Mumbai, Oct 13: The Bombay High Court ordered on Thursday the Brihanmumbai Municipal Corporation (BMC) to accept Rutuja Latke’s resignation request so that she can run in the upcoming by-elections for the Maharashtra State Assembly’s Andheri (East) constituency.

Notably, Rutuja Latke was the late Shiv Sena MLA Ramesh Latke’s wife. Justices Nitin Jamdar and Sharmila Deshmukh’s panel questioned BMC about its inability to make its position on the matter clear.

A clerk wants to resign, why are you not exercising the discretion? She wants to contest the election, tomorrow is the last date for nomination, when will you exercise discretion,” the Court demanded.

After receiving instructions, Senior Advocate Anil Sakhare, representing BMC, informed the Court that Latke was the subject of a complaint dated October 12 that included accusations of corruption and liaisoning as well as claims that she was not showing up for work.

The Court ordered BMC to send a letter to Latke accepting her resignation by tomorrow at 11 a.m. after spending some time listening to both sides.

The Bench added that BMC should not place too much emphasis on the resignation of a clerical staff member. Latke, the late Shiv Sena MLA Ramesh Latke’s wife, has petitioned the High Court to order the BMC to accept her resignation as an employee of the municipal organisation so she can run in the impending by-elections for the Maharashtra State Assembly’s Andheri (East) constituency.

Because Latke’s husband passed away in May of this year, a bye-election is being held. Before the party’s split in June of this year, when the Eknath Shinde faction left and sided with the BJP, he was a Shiv Sena MLA.
