SC dismisses plea to declare Subhash Chandra Bose’s birth anniversary as national holiday

New Delhi, Nov 14: A public interest litigation (PIL) plea asking for the proclamation of a national holiday on Parakram Diwas, the anniversary of Netaji Subhas Chandra Bose’s birth, was denied by the Supreme Court of India on Monday.

A panel of Chief Justice of India DY Chandrachud and Justice JB Pardiwalla stated that the argument was nothing more than a parody of PIL jurisdiction and that the government of India, not the supreme court, should have jurisdiction over the subject.

“This is a matter for Government of India. What will Supreme Court Do? Take jurisdiction of the court seriously. You are also a lawyer,” the Court said.

The petitioner’s attorney questioned the court about why the day couldn’t be observed while other holidays like Children’s Day and Buddha Purnima are observed nationwide.

Instead of looking for a holiday, the Court advised celebrating the day by working hard the way Bose struggled for freedom. It dismissed the petition on the grounds that the petitioner was making a mockery of the PIL jurisdiction.

“You can celebrate it by working hard just like how he worked hard for independence…You are making a mockery of the PIL jurisdiction. You like blue skies and then you will come in PIL saying you want blue skies? At least think what the court can do….The 3 minutes that we spent on your petition could have got relief for another litigant you see. Sorry dismissed,” it stated.
