Bombay HC extends stay on bail order of Anil Deshmukh

Mumbai, Dec 21: The order giving bail to Anil Deshmukh, a former state home minister, in the CBI investigation was extended by the Bombay High Court on Wednesday.

After Tuesday, according to Justice MS Karnik, his order will go into force.

“The order now will be effective after Tuesday 27th December. It is made clear that no further request under any circumstances will be entertained,” the court said.

After the Bombay High Court granted bail to Deshmukh in the corruption case, the CBI contacted the SC within two days, but the vacation bench was not accessible, according to ASG Anil Singh for the agency.

“There has to be balance and we should also get an opportunity. Whether we will succeed Before SC or not is a different issue,” he said.

He urged the court to extend the protection till the reopening of the court.

“Why has it not come up in Supreme Court immediately after it was filed?” Justice Karnik asked.

He questioned if the HC would even consider the possibility of the SC being involved.

“Lordship has the power to consider my application. On merits I understand but not on this ground that SC is seized”, Singh said.

Since November 2, 2021, Deshmukh has been detained. The former Home Minister had previously been granted bail by the High Court in a money laundering case as well, which the Supreme Court refused to overturn.

Deshmukh was charged by the CBI with violating Sections 7 of the Prevention of Corruption Act and 120B of the Indian Penal Code. According to the plea, the preliminary investigation, prima facie, showed that a cognizable offence was made out against Deshmukh, where he along with unidentified people had tried to earn an unfair advantage for inappropriate and dishonestly performing a public job.

According to the appeal before the Supreme Court, the High Court made a serious mistake when it granted bail to Deshmukh because it neglected to take into account the implications of doing so while additional inquiry was still ongoing.
