Ranchi, July 14: The Jharkhand High Court today directed the state government and the assembly secretariat to file an affidavit in the matter to appoint the leader of opposition within three days clearing two points. The two points included whether the issue of leader of opposition can be decided during the pendency of cases of anti-defection before the assembly and whether the high court can direct the speaker to appoint leader of opposition.
A division bench headed by Chief Justice Sanjaya Kumar Mishra gave the direction while hearing a petition filed by Raj Kumar demanding immediate appointment on 12 constitutional posts lying vacant in the state due to lack of leader of opposition.
Advocate Abhay Mishra confirmed the direction saying that the next hearing in the case will take place on July 25.
