Ranchi: The 57th meeting of the GST Council will be held in Delhi on October 8, where an amendment to Section 69 of the GST law is likely to be considered, raising hopes of some relief for traders from arrest in tax evasion cases.
What Section 69 Currently Provides
Under Section 69, the Principal Commissioner and Commissioner have the power to order the arrest of a trader if fake GST invoices are generated. At present, arrest can be ordered where a trader issues GST bills without any actual supply of goods or services and wrongly claims input tax credit (ITC) of Rs 2 crore.
Proposed Increase in Threshold
Trade bodies have been demanding changes to this provision. It is reportedly likely that the Council will raise the minimum tax evasion amount required for ordering an arrest from Rs 2 crore to Rs 5 crore.
