Champai Soren Accuses State Government of Undermining Tribal Rights Through PESA Changes

Ranchi: Former Chief Minister Champai Soren has strongly criticized the Jharkhand government over recent changes to the implementation of the PESA Act, accusing it of plotting to eliminate tribal communities by diluting the very law meant to protect their identity, traditions, and existence.

PESA Provisions Weakened, Says Soren

In a social media post, Soren stated that by removing key provisions of the 1996 PESA Act—especially those protecting customary laws, social and religious practices, and traditional systems—the government has undermined the spirit of the legislation. He alleged that introducing vague terms like “consent” instead of “permission” from Gram Sabhas and automatic approval after 30 days indicates an attempt to reduce the powers of tribal village assemblies.

Traditional Rights and Decision-Making Undermined

Soren further warned that allowing non-traditional individuals into decision-making roles under Gram Sabhas compromises the authenticity of tribal leadership. He condemned the removal of rights granted to Gram Sabhas during his tenure—such as the power to reclaim land in CNT-SPT Act violations and the requirement for DCs to seek approval before land transfers in scheduled areas.

State Undermining Governor’s Role and Tribal Safeguards

The former CM pointed out that the government had removed the Governor’s involvement from the Tribal Advisory Council (TAC) and is now shifting critical powers from the Governor to district collectors, particularly in scheduled areas. He argued that such steps are meant to centralize control and bypass tribal consent, which contradicts both the spirit of PESA and Supreme Court precedents that upheld tribal religious beliefs.
