New Delhi, Feb 10: Supreme Court on Thursday has declined to urgently list a plea seeking transfer of the petitions from Karnataka High Court relating to Hijab row to the apex court.
Supreme Court says HC is getting the matter today and asked why it should interfere at this stage. The apex court refused to give any specific date.
“Let the HC examine and decide the issue. Why should we jump in at this stage? It does not look nice,” CJI NV Ramana said.
Girls are being stoned, and schools and institutions are collapsing, according to senior counsel Kapil Sibal, who is representing the petitioners. Exams are only two months away. He requested that Chief Justice of India NV Ramana submit the case to a nine-judge SC bench.
According to Sibal, similar instances regarding women’s access to Sabarimala and Mosques should be adjudicated before a 9-Judge court, and the hijab issue should be shifted from the Karnataka High Court to the same 9-Judge bench.
The Supreme Court should list the transfer petition and keep it pending, according to Kapil Sibal.
The CJI said that if the SC intervenes in this way, the HC will never hear the case because it is pending before the SC.
Meanwhile, Karnataka CM Basavaraj Bommai is going to hold a meeting with officials over the matter.
“I’ll hold a meeting with Primary & Secondary Edu Minister BC Nagesh & officials along with State Home Minister to discuss briefly whatever happened. Will take a decision today evening on extending closure of all high schools and colleges,” said CM Basavaraj Bommai.
