Nawab Malik moves Bombay HC for bail in money laundering case

Mumbai, Dec 11: The Bombay High Court will hear the bail request made by former Maharashtra cabinet member Nawab Malik on Tuesday in a case concerning money laundering that involves mafia don Dawood Ibrahim.

Malik petitioned the High Court after his request for bail in the case was denied by a Mumbai special court on November 30.

Primary evidence suggests that the deceased Hasina Parkar, Salim Patel (who is connected to Dawood), and Malik conspired to seize prime land owned by Munira Plumber and her mother Mariyum Goawala, according to special judge RN Rokade.

The Court had acknowledged that while Malik was not named in the scheduled offense but even otherwise, every process or activity, fell within the ambit of the definition of money ­laundering.

Malik has argued before the High Court that the special court denied his bail despite discovering problems with witness Munira Plumber’s testimony.

It has been argued that by doing this, the special court disregarded Malik’s serious medical condition.

Malik is currently receiving medical care while being treated in a private facility. He was detained by the Enforcement Directorate (ED) on suspicion of buying a property from Ibrahim for less money than it was worth.

Malik was allegedly forced to sign the summons that ED had given him before being taken away from his home at 7 am on February 23 for questioning. Malik was detained and held in ED custody for 8 days before being transferred to judicial custody following an over 8-hour questioning. Malik had also filed a Habeas Corpus plea with the Bombay High Court, but it was denied. The Supreme Court upheld the same.

Malik has requested regular bail in accordance with Section 439 of the Code of Criminal Procedure after the Special PMLA Court received notice of the chargesheet in May 2022.
