Ranchi, Dec.17: The special CBI court in the Jharkhand capital today framed charges against five accused, including two doctors in a case of deviation of the building plan.
The two doctors are Rani Children Hospital director Dr Rajesh Kumar and Dr Sudhir Kumar of Jagannath Hospital while the other three include RRDA officials Ram Kumar Singh, Umesh Prasad Singh and Vinod Kumar Singh.
All the accused will be prosecuted under sections 13(2), 13(1)(D) of the Prevention of Corruption (PC) Act and sections 120 (conspiracy) and 420 (cheating) of the Indian Penal Code (IPC).
Section 13(2) of the PC Act, 1988 is imposed when any public servant commits criminal misconduct and it is punishable with imprisonment for a term not less than one year but it may be extended to seven years and shall also be liable to fine.
Section 13(1) (d) is imposed when it is found that a government servant obtains for himself or for any other person any valuable thing or pecuniary advantage by corrupt or illegal means
The charge has been framed more than 11 years after the CBI registered an FIR in the case and nine years after the CBI filed a charge sheet in the case.
“On March 25, 2011, the CBI had registered an FIR against all the accused. It is being alleged the doctors produced fake documents and RRDA officials approved building plans without proper verification of documents. CBI had filed a charge sheet in the case in the year 2013,” a civil court lawyer acquainted with the case said.
