Ranchi, April 14: The Jharkhand police asked BJP state president and Rajya Sabha member Deepak Prakash and other BJP workers to appear at the Dhurwa police station on April 22 for questioning in a case of rioting, disobeying government instructions, obstructing official works, abetment to commission of an offense and causing harm to another person.
The case in which the senior BJP leader Prakash has been called was registered after a clash between BJP workers and the police took place at Dhurwa round about on April 11. They were marching to the Secretariat under the ‘Hemant hatao’ campaign.
The case was registered on the statement of executive magistrate Upendra Kumar. As many as 41 people, including three former CMs and 5 MPs were named in the FIR.
Among those who have been named included parliamentarian Sanjay Seth, Nishikant Dubey, Sameer Oraon, Sunil Kumar Singh, Arjun Munda, former chief ministers Raghubar Das and Babulal Marandi and MLA Viranchi Narayan.
Other named in the FIR included Shyamanandan Ojha, Shatrughan Singh, Aarti Kujur, Pradeep Mukherjee Anita Soren, Munchun Rai, Umesh Yadav, Virendra Yadav, Lalit Ojha, KK Gupta, Kulwant Singh Binti, Ashok Kumar, Ramesh Singh, Ramesh Nath Tiwari, Sanjeev Kumar Singh, Brajkant Kesari, Gunjan Yadav, Amit Kumar, Vikas Kumar Pandey, Dilip Kumar Singh, Kumkum Devi, Kameshwar Singh, Amit Bhaiya alias Amit Kumar, Kamlesh Ram, Neelam Chowdhary, Sadhu Manjhi, Vimal Marandi, Anand Yadav, Trilochan Kumar Paswan, Sanju Pandey and Amar Nath Kumar Singh and Deepak.
The clash took place when the police intercepted a procession of 20,000 BJP workers including several BJP MLAs and MPs progressing towards state secretariat under its “Hamant Hatao” campaign.
The clash left several BJP workers, journalists and police officials injured. Most of the injuries took place when the police resorted to lathi charge after water cannon and tear gas shells failed to disperse the agitating BJP workers and later started running helter-skelter.
Officer-in-charge of Dhurwa police station Vimal Nandan Sinha confirmed the development saying the notice under section 41-A of Criminal Procedure Code (CrPC) was issued by investigating officers of the case today.
What is Section 41-A of CrPC
It is a notice of appearance before police officer
(1) [The police officer shall], in all cases where the arrest of a person is not required under the provisions of sub-section (1) of section 41, issue a notice directing the person against whom a reasonable complaint has been made, or credible information has been received, or a reasonable suspicion exists that he has committed a cognizable offence, to appear before him or at such other place as may be specified in the notice.
(2) Where such a notice is issued to any person, it shall be the duty of that person to comply with the terms of the notice.
(3) Where such person complies and continues to comply with the notice, he shall not be arrested in respect of the offence referred to in the notice unless, for reasons to be recorded, the police officer is of the opinion that he ought to be arrested.
(4) Where such person, at any time, fails to comply with the terms of the notice or is unwilling to identify himself, the police officer may, subject to such orders as may have been passed by a competent Court on his behalf, arrest him for the offence mentioned in the notice.
